End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a binding agreement between you ("User" or "you") and Figment Labs, LLC ("Company", "we", "us", or "our"). This Agreement governs your use of our fantasy football mobile application (the "App").

By downloading, accessing, or using the App, you agree to be bound by this Agreement. If you do not agree to the terms of this Agreement, do not use the App.

1. License Grant

Subject to the terms of this Agreement, Figment Labs, LLC grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App solely for your personal, non-commercial use on a device that you own or control.

2. Restrictions

You agree not to:

• Copy, modify, or create derivative works of the App;

• Reverse-engineer, disassemble, decompile, or attempt to derive the source code of the App;

• Rent, lease, lend, sell, sublicense, or distribute the App;

• Use the App for any unlawful purpose or in any manner that could damage, disable, overburden, or impair it.

3. User Conduct and Prohibited Content

By using the App, you agree to the following terms:

a. Acceptable Use

You will use the App in compliance with all applicable laws and regulations and in a manner that respects the rights of other users.

b. Prohibited Conduct

You must not post, upload, distribute, or otherwise transmit through the App any content that:

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or libelous;

• Invades another’s privacy;

• Contains hate speech, discriminatory remarks, or promotes violence;

• Is sexually explicit or otherwise objectionable;

• Harms or exploits minors;

• Constitutes spam, phishing, or deceptive content.

c. Zero Tolerance Policy

Figment Labs, LLC maintains a zero-tolerance policy for objectionable content and abusive behavior. We reserve the right to suspend or terminate your account at any time, without notice, for any violation of this section. Violations may be reported to relevant authorities when appropriate.

4. Intellectual Property

The App and all content, features, and functionality are owned by Figment Labs, LLC or its licensors and are protected by copyright, trademark, and other laws. You may not use any of our intellectual property without prior written consent.

5. Termination

This Agreement is effective until terminated by you or Figment Labs, LLC. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any of its terms. Upon termination, you must cease all use of the App and delete all copies from your devices.

6. Disclaimers

The App is provided “as is” and “as available” without warranties of any kind. Figment Labs, LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free or uninterrupted.

7. Limitation of Liability

To the fullest extent permitted by law, Figment Labs, LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of or inability to use the App.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of [Insert State], without regard to its conflict of law principles. Any disputes arising under or in connection with this Agreement shall be resolved in the courts located in [Insert County, State].
